What types of Cases can be brought via a class action?

  • Securities Class Actions: A securities class action is brought when a group of investors have been injured as a result of usually a mishandling of information, pump and dump schemes, concealing or misrepresenting risks, conflict of interests or other information that was detrimental to the shareholder or company.
  • Product Liability/Personal Injury Class Actions: These can be faulty acceleration pedals, dangerous drugs, medical devices that were improperly designed, or even toxic spills that harm a large number of people.
  • Consumer Class Actions: These are illegal practices that are done by a business that hurt a consumer. These may be incorrect charges, illegal penalties for late payments, and other failures to comply with consumer protection laws.
  • Employment Class Actions: These again hurt the consumer. They may occur when an employer does not pay overtime pay, failure to provide breaks, and other failures to abide by the Labor Code.

How many people are needed for a class action?

There is not a specific number of people that need to be harmed in order to file a class action lawsuit. Typically class action lawsuits have more than 30 people, however, in some cases there are far fewer. Who pays for the class action?

Class actions can be very expensive and very time consuming. Generally, the lawyers will front all of the costs of the litigation. The judge will then approve the lawyer’s pay at the end of litigation. Like all of our cases we work on contingency, if we don’t win, we don’t get paid.

Sometimes your case would be too small to bring on its own. Many times the monetary damages are not enough to pursue a claim on its own.
