We represented a young man who was driving his motorcycle after spending time with his family after an Easter gathering. As he was driving his motorcycle a car pulled out into the road and our client smashed into his vehicle. Our client was immediately rushed to the hospital. The police said that if he hadn’t been wearing his helmet he would have been killed.
At the hospital they worked on restoring function back to his extremities and to help with his cognitive brain problems. After he recovered he visited several prominent lawyers who advised him to take the 50,000 dollars of insurance money. Luckily, he visited our law firm who took a strong stance against the insurance company. We believed that the release that was drafted in order for him to receive the 50,000 dollars was too broad and over inclusive. We were able to get the insurance company to “open the policy” or in other words provide unlimited coverage for the accident.
The lawyers at Krause and Kinsman visited with several of his treating doctors and met with many family members and friends. We made a montage video in order to showcase the witnesses that would be ultimately called to trial if the insurance company didn’t pay. We worked up the case from the beginning as if it was going to go to trial. At the mediation, the insurance company knew that they were going to be hit with a large verdict and ultimately decided to pay out more than 700,000 dollars to our client. Again, this is a case that many lawyers told our client to take the 50,000 dollars and walk. Now, our client is going to be able to pay for future care, pay off all medical bills and take care of any other debt the accident caused.
