On March 13, 2013, at approximately 5:21 am, our client was a passenger in the front seat of her car driven by her best friend. Little did she know that a few seconds later her life would be changed forever. They were driving East on I-70 towards Independence, Missouri. The driver of the vehicle was driving too fast for the road conditions and missed the exit that they were supposed to take in order to make their destination. In an attempt to make the exit, the driver jerked the wheel crossing three lanes of traffic and rolled the vehicle three times. Ambulances rushed to the scene of the accident. Our client thought she was going to die. She could barely breathe and couldn’t move her legs.
Our client approached two lawyers who told her that the maximum amount of money that she could receive in this case was 50,000 dollars. We believed that the insurance company was making a mistake with the policies and we wouldn’t be limited to the 50,000 dollars of coverage. After several months of going back and forth with the insurance they ultimately acquiesced to “opening the policy.” This means, that our client had an unlimited amount of money to go after for her injuries that she sustained in the accident.
Our team of lawyers hired a vocational rehabilitation expert, economist, orthopedist, lifecare planner and several treating physicians to help us in working up the case for maximum value. Ultimately, the case settled for 1,750,000 one month before trial. Prior to this settlement, the insurance company had originally offered a take it or leave it offer of 50,000 dollars. Our client was able to use the money to buy a new vehicle, a new house, and pay for any surgeries that may be needed down the road.
